TERMS AND CONDITIONS OF FUNDINGGUYHK 

1. ACCEPTANCE OF TERMS 

By accessing the website fundingguyhk.com (the "Website") and using any services, AI tools, or training materials provided by Fundingguyhk (the "Services"), you agree to be bound by these Terms and Conditions. If you do not agree, you must cease using the Services immediately. 

2. ELIGIBILITY 

The Services are intended for business entities, Non-Governmental Organizations (NGOs), and social enterprises. By using our Services, you warrant that you are at least 18 years old and have the legal authority to bind your organization to these Terms. 

3. INTELLECTUAL PROPERTY RIGHTS 

 3.1 All content provided through the Services, including but not limited to AI prompt frameworks, funding application strategies, proposal templates, video tutorials, and technical methodologies (the "Proprietary Materials"), are the exclusive property of Fundingguyhk and are protected by Hong Kong copyright and intellectual property laws. 

3.2 You are granted a limited, non-transferable, and revocable license to use the Proprietary Materials for your organization’s internal funding applications only. You shall not repackage, resell, distribute, or use these materials to provide competing consultancy services to any third party. 

4. DISCLAIMER - NO GUARANTEE OF FUNDING 

4.1 Fundingguyhk provides strategic tools and educational resources based on past experience. You expressly understand and agree that the final decision to award any funding lies solely with the respective government departments, foundations, or granting agencies. 

4.2 Fundingguyhk makes no warranty or guarantee, express or implied, that your use of the Services will result in a successful funding application or any specific financial outcome. Results vary depending on the project nature, organizational capacity, and external policy changes. 

5. USER RESPONSIBILITIES 

You are solely responsible for the accuracy and legality of all information submitted in your funding applications. Fundingguyhk shall not be liable for any rejected applications due to fraudulent information, late submissions, or failure to meet the granting agency’s criteria. 

6. LIMITATION OF LIABILITY

 6.1 To the maximum extent permitted by the laws of Hong Kong, Fundingguyhk shall not be liable for any direct, indirect, incidental, or consequential losses, including loss of potential funding, loss of business opportunities, or reputational damage.

6.2 Nothing in these Terms shall exclude liability for death or personal injury caused by negligence, or for fraud, as prescribed under the Control of Exemption Clauses Ordinance (Cap. 71). 

7. INDEMNIFICATION 

You agree to indemnify and hold Fundingguyhk harmless from any claims, damages, or legal costs arising from your breach of these Terms or your infringement of any third-party rights. 

8. CONFIDENTIALITY 

You agree to keep all strategies and AI frameworks provided by Fundingguyhk confidential and shall not disclose them to any external party without our prior written consent. 

9. MODIFICATIONS TO TERMS 

Fundingguyhk reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Website. Your continued use of the Services signifies acceptance of the revised Terms. 

10. GOVERNING LAW AND JURISDICTION 

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any disputes shall be subject to the exclusive jurisdiction of the courts of Hong Kong. 

11. THIRD PARTY RIGHTS 

A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Ordinance (Cap. 623) to enforce any part of these Terms.
